Terms of Service

Welcome to Nowa Chat. These Terms of Service (“Terms”) constitute a legally binding agreement between you and BOUSSELHAM (“Developer”, “we”, “us”, or “our”) concerning your access to and use of the Nowa Chat: Meet New People mobile application and associated web services.

1. Eligibility and Age Requirements

You must be at least 18 years of age to register an account or use Nowa Chat. Nowa Chat is designed for social discovery and dating; minors under the age of 18 are strictly prohibited from using the service under any circumstances. By creating an account, you represent and warrant that you are 18 years of age or older.

2. Device-Stored Conversations

Because the app provides strong end-to-end encryption, your private conversations and media are stored locally on your device:

1. We do not maintain centralized cloud backups of your personal chat history.
2. If you lose your device, damage your device storage, or uninstall the application, your prior conversation history cannot be recovered by our team. You are responsible for maintaining your device security.

3. Single-Device Policy and Session Security

You are permitted one active device per account at any time:

• Logging in on a new device will immediately terminate your active session on your previous device.
• Any undelivered messages pending transmission to the prior device session will be cleared to protect your privacy.

4. Acceptable Use and Prohibited Conduct

You agree not to use Nowa Chat for any unlawful or abusive purposes, including:

• Distributing illegal content, malware, spyware, or malicious payloads.
• Harassing, threatening, defaming, impersonating, or stalking other individuals.
• Operating automated spam bots or attempting to overload platform services.
• Reverse engineering or attempting to circumvent rate limits, security measures, or access controls.
• Any form of child sexual abuse and exploitation (CSAE/CSAM), which results in immediate ban and criminal referral.

5. Content Reporting and Verification

Because communications are end-to-end encrypted, our servers cannot inspect chat text in transit. Consequently:

• Moderation relies on user-initiated abuse reports.
• When you submit a report via the in-app 3-dot menu, your client transmits an excerpt of the relevant message text along with a verification tag.
• This tag allows our safety team to verify that the reported message genuinely originated from the reported account without tampering.
• Submitting deliberately fraudulent, fabricated, or altered reports is grounds for immediate and permanent account ban.

6. Nowa Points, Daily Rewards, and Lucky Wheel

1. Digital Utility Tokens Only: Nowa Points are non-monetary, strictly digital utility tokens used to interact within the app (such as sending messages or participating in discovery features).
2. Earning Points: Points are earned through complimentary in-app activities, including daily login bonuses (+15 Nowa Points per day) and free daily spins on the Lucky Wheel.
3. No Monetary Value: Nowa Points have zero monetary or cash value, do not represent property, and cannot be redeemed, refunded, transferred, exchanged, or withdrawn for real-world fiat currency or monetary items.
4. Append-Only Integer Ledger: Points are maintained strictly in an append-only integer ledger. Balances cannot be fractional.
5. Fair Play & Idempotency: Daily login rewards and Lucky Wheel spins are strictly limited per user. Any attempt to exploit, duplicate, or automate reward collection will result in ledger forfeiture and immediate account suspension.
6. Administrative Adjustments: We reserve the right to audit and correct ledger rows in instances of technical error, exploit, or rule violations.

7. Suspension and Termination

We reserve the right to suspend or permanently ban your account at our sole discretion for violations of these Terms:

• An account ban revokes all device tokens immediately and terminates active connections.
• Every disciplinary action is logged with mandatory justification in our administrative audit records.

8. Disclaimers and Limitation of Liability

NOWA CHAT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOUSSELHAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, DEVICE DAMAGE, OR INTERRUPTION OF COMMUNICATION.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Competent Jurisdiction, without regard to conflict of law principles. Any legal disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Competent Jurisdiction.
